For the past 1,224 days, J6 political prisoner Jake Lang has been held without trial by the Biden DOJ. He has already been denied bail twice.
Yesterday was his third and final attempt to be released, in preparation for an extensive defense for trial.
In court yesterday, Jake Lang, his legal team from Metcalf & Metcalf and attorney Anthony Sabatini engaged in intense legal arguments for nearly two hours.
DOJ federal prosecutors Karen Rochlin and Craig Estes sought to keep Lang in indefinite custody.
Under federal law, “liberty is the norm,” and only in the most extreme circumstances will a suspect remain in jail, in accordance with the new Bail Reform Act (BRA).
Lang and his legal team argued that BRA clearly states that there must be a “clear, articulated threat posed by the suspect to his community or individuals”; In other words, keeping someone in indefinite pre-trial detention for a period of 3.5 years cannot be based solely on the assumption of future violent behavior; there must be a definitive threat that someone imposes.
While career criminals, carjackers, and the illegal aliens who keep NYPD officers in check are given preferential treatment and released on bail, Lang and other political prisoners are being selectively prosecuted on January 6 with misinterpreted, overbroadly applied and weaponized federal laws like the 20 years Crime of 1512 Obstruction of Congress.
Judge Carl J Nichols ended the Bond hearing by saying he was hearing the motion and will respond via a written decision “sometime in the near future.”
Mr Nichols has already denied bail for Lang (who has no criminal record) twice.
Jake has been in custody for 1,224 days since January 16, 2021, when the FBI raided his home in Newburgh, NY.
Long hopes Jake will have the opportunity to prepare a robust defense at home before his trial on September 9, 2024, although his trial date has already been canceled and rescheduled four times.
