Lawyers for Rachel Leviss slam Ariana Madix after she calls wiretapping lawsuit 'abuse of legal process'

Sandoval dismissed the lawsuit earlier this month.

She claimed that Madix, who was dating Sandoval, discovered their affair after finding the videos on Sandoval's phone.

Leviss accused Madix and Sandoval of distributing the video to third parties. She sought unspecified damages in her lawsuit.

Sandoval said his ex filed the lawsuit to “increase her fame.”

As we first reported, Sandoval recently destroyed the lawsuit. His lawyers accused Leviss' lawsuit of being a “thinly veiled attempt to expand her fame and rebrand herself as a victim instead of the other woman, while denigrating her former friend MADIX as a “woman scorned” and her former lover SANDOVAL as “predatory.”

Leviss' lawyers, Bryan Freedman And Mark Geragos, destroyed Sandoval. They said: “Sandoval's response to the irrefutable evidence that will be presented in court is disturbing. Exploiting such claims for media attention and perpetuating victim blame is not only deplorable, but actionable.”

Madix denied sharing the video.

Now Madix has filed a motion to dismiss the case. According to court documents obtained by RadarOnline.com, Madix claimed to be “devastated” after finding the video on Sandoval's phone. She said she immediately confronted her then-boyfriend.

In its application, Madix refused she showed or shared the FaceTime video with third parties.

“In fact, Ms. Madix could not have shared such footage because Mr. Sandoval deleted it from her phone within minutes of Ms. Madix confronting him – a fact that Ms. Madix stated in writing 33 minutes after she sent the videos to [Leviss]” was her response.

Madix's attorney accused Leviss of “punishing her and blaming Ms. Madix for the negative response [Leviss] received as a result of her affair with Mr. Sandoval.”

Additionally, they called the lawsuit an “abuse of the legal process.”

Sandoval moved to dismiss all claims against him.

“[Leviss] does not seek to defend any discernible rights, but rather to punish Ms. Madix and deter others from exercising their constitutionally protected right to freedom of expression,” the lawsuit said.

Now, Released man And Geragos, Leviss' legal team, fired back. They told us: 'The only thing more ridiculous than Ariana's move is her fairy tale story of how she discovered the relationship through Tom's phone. In the meantime, we look forward to questioning her about her statement as we have irrefutable evidence that the videos were distributed.”
