The 'Rizzoli & Isles' actress has filed a lawsuit against delivery company and driver Christopher Anthony Reid alleging trespass, conversion, negligence, negligent supervision/hiring, invasion of privacy and negligent misrepresentation.

In the complaint, Harmon alleged that while planning the birth, she believed she was communicating with an older woman named “Merle.” Instead, Reid, described as “a tall and intimidating younger man,” had “posed as Merle on the Instacart app” and was the one who showed up to fill the order.

When Reid arrived, Harmon's attorneys said she “heard what sounded like a gunshot” and “terrified for the safety of her children, Ms. Harmon immediately ran downstairs to determine where she thought it was a gunshot.”

Harmon said she saw Reid “place a gun down the front of his pants, possibly in his pocket.” She looked over and saw that her beloved dog, Oliver, had been shot. Even though he was shot, Oliver was still alive.”

Oliver, a German shepherd-beagle mix, died shortly after being rushed to the vet's office.

When police arrived and questioned Reid about the incident, he admitted to shooting the dog but claimed it attacked him and acted in self-defense.

“The driver told officers that a dog had attacked him while he was in the residence and that he defended himself by firing a single shot, striking and fatally wounding the dog. There was another dog present in the home, but it did not attack,” said Charlotte. The Mecklenburg Police Department said this in a statement.

Although the investigation concluded without criminal charges being filed, Harmon claims in the lawsuit that Reid was “not injured” or “seriously threatened” by the dog and had “ample opportunity” to safely leave the property without putting the dog down to shoot.

Last month on Instagram, Harmon wrote: “This Easter weekend, a man delivering groceries for #Instacart shot and killed our precious Oliver. He got out of his car, delivered the food, then shot our dog. Our Ring camera was charging in the house, which he saw and then knew he wasn't being answered.”

“The police let him go because he claimed 'self-defense'. He had no scratches or bites and his pants were not torn. He was shopping under the identity of a woman named Merle… He shot our dog with my daughters and myself at home and kept saying, 'Yes, I shot you. dog. Yes I did that.' We are completely traumatized and beyond devastated by the loss of our beloved boy and family member.”

In an interview on ABC Good morning America this week, Harmon said, “It's so unfathomable to think that there's someone in your driveway who just fired a gun. You never forget that sound. I heard my youngest scream. I just heard her say, 'Did you do that ?' just shoot my dog?' I thought, 'What?'”

“I don't think Instacart is responsible for any of this,” she added. 'For example, this didn't have to happen. And you know, the damage it has done to our family.”

In a statement, Instacart said: “Our thoughts remain with Ms. Harmon and her family following this disturbing incident. While we cannot comment on pending litigation, we do not tolerate violence of any kind and the shopper account has been permanently deactivated from our platform.”
